1. Introduction

We, "LetsChat" is also known as "LetsChat Messenger" is brought to you by "Growth Zone Pvt. Ltd." based in India, respect the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit and use our LetsChat Messaging Application (the "Application").

Please read this Privacy Policy carefully. IF YOU DO NOT WANT US TO PROCESS YOUR INFORMATION AS OUTLINED IN THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of this Privacy Policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, and will be subject to, any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted.

This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

2. Collection of Your Information

We may collect and synchronise information about you in a variety of ways. The reasons why we need this information or otherwise use this information are set out in Section 3.

The information we may collect on the Application includes:

  • Personal Data : You're personally identifiable information, such as your mobile phone number, Email id, Google account id, Facebook account id, name, gender and profile photo, which will be obtained at the point of your registration. Demographic information, such as your gender, and self-description, that you voluntarily give to us when you set up your personal profile page. Your up-to-date phone contacts, your feedback, call log and security SMSs that are sent to you for verification purposes when you access the Application, including sender, receiver, content of SMS and time of delivery.
    You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Application.
  • Derivative Data : Information our servers automatically collect when you access the Application, such as your IP address. This information may also include your device name and type, your android mobile version, your phone number, your country, and other interactions with the Application and other users via server log files, as well as any other information you choose to provide.
  • Mobile Device Data : Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device (in order to provide certain features of the Application that are based on your location). Further information setting out how we use this information is set out in Section 3 below.
  • In-App Communications : The content of your chatrooms and private chat. This is required to provide chatting services to you.
    When you communicate with others by sending or receiving messages, we will store and process your communications and information related to them. This includes link scanning for malicious content, detection of spam, abuse and prohibited images, and use of reported issues. We also use information about whom you have communicated with and when (but not the content of those communications) to better understand the use of our services, to protect the safety and integrity of the application, and to show more relevant chatrooms. We share the content of your chat with the people you have sent them to; we do not use them to serve you ads. When you engage in private chats, remember that recipients have their own copy of your communications - even if you delete your copy of those messages from your account - which they may duplicate, store, or re-share.
  • Mobile Application Information : Geo-Location Information. We may request access to or permission to track location-based information from your mobile device, while you are using the Application, to provide location-based services. This information is needed to provide certain features of the Application that are based on your location. If you wish to change our access or permissions, you may do so in your device's settings.
    Mobile Device Access. We may request access or permission to certain features from your mobile device in order to provide certain features of the chatting and messaging service such as the voice message function, location-based functionality, and security verification via SMS, including:
    • Mobile device's camera;
    • Contacts;
    • Microphone;
    • Phone;
    • Location;
    • SMS messages and storage;
    Mobile Device Data.We may collect device information (such as your mobile device ID, model and manufacturer), android version information and IP address.
    Push Notifications.We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in a smart phone device's system Settings.

3. Use of Your Information

The information that we collect from and about you is necessary for us to provide you with a smooth, efficient, and customised experience. Specifically, we may use information collected about you via the Application to:

  • Complete your registration on the Application and set up your personal profile page;
  • Carry out internal data analysis;
  • Provide chatting services to users;
  • Compile anonymous statistical data and analysis for use internally or with third parties;
  • Create and manage your account;
  • Deliver information regarding the Application to you;
  • Enable user-to-user communications;
  • Generate a personal profile about you to make future visits to the Application more personalised;
  • Increase the efficiency and operation of the Application;
  • Monitor and analyse usage and trends to improve your experience with the Application;
  • Notify you of updates to the Applications;
  • Offer our new features, services, and/or recommendations to you, unless you tell us that you do not want to get communications from us in this regard;
  • Perform other business activities as needed;
  • Assist law enforcement and respond to subpoenas;
  • Prevent fraudulent communications, monitor against theft, and protect against criminal activity;
  • Request feedback and contact you about your use of the Application;
  • Resolve disputes and troubleshoot problems; and
  • Respond to issues and user service requests.

We will only process your personal information where we have a lawful basis on which to do so such as where you have given your specific consent (for example, in the context of location information), where the information is needed to provide the Application to you and the Application cannot be provided without that information, in terms of our legal obligations, on the basis of your legitimate interests, and in some instances and where it is permissible in your country, where we or a third party have a legitimate interest in processing the information. Where we rely on legitimate interest for processing your information, we carry out a 'balancing test' to ensure that our processing is necessary and that your fundamental rights of privacy are not outweighed by our legitimate interests, before we go ahead with such processing.

  • Interaction with Other Users: If you interact with other users of the Application, those users may see your name, profile photo, username and descriptions of your activity, including that you have sent messages to other users and chatted with other users.
  • By Law or To Protect Rights: If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by the applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction.

    We only retain your information for as long as is necessary for the purposes described above.. We may retain some of your information after you cease to use our services, for instance if this is necessary to meet our legal obligations. When determining the relevant retention periods, we will take into account factors including:

    • Our contractual obligations and rights in relation to the information involved;
    • Legal obligation(s) under applicable law to retain data for a certain period of time;
    • Our legitimate interest where we have carried out a balancing test;
    • Statute of limitations under applicable law(s);

We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

    • Push Notifications and Communications If you no longer wish to receive push notifications, or other communications from us, you may opt-out by:
      • Logging into your smart phone system Settings and updating your preferences.
      • Contacting us using the contact information provided below.
    • Withdraw Your Consent You may withdraw your consent (where relevant) to our access or permissions in the system Settings of your smart phone.
    • Delete Your Account If you wish to delete your account, you may request from application or send us an email with the following information: you're mobile phone number, Email id, Google account id, Facebook account id, country, request for reregistration and the reason. We will reply to you to verify if you are the account owner. Upon the completion of such verification, we will proceed to permanently delete your account within sixty (60) working days.

    LetsChat maintains proper organisational and technical measures for preventing the personal details under our control from being lost, accessed, or used accidentally in an unauthorised manner, disclosed, or altered during the gathering, storage, & processing. All details you offer to LetsChat get stored on the limited-access, secure servers behind firewalls. Access to the account, personal information, and data is restricted within the Company to trusted partners and employees that require access to your details for corresponding with you & offering the services and/or products requested by you from us. Also, your personal information & data is password-protected so that you only can log-in to the account. Any extra safeguards utilised for protecting personal details will depend upon the personal information's sensitivity, distribution, format, amount, & storage method.
    While the security measures seek to safeguard your details in our possession, no safety system is perfect & we can't guarantee that the personal details will stay 100% secure in every circumstance or that any security measures/privacy settings utilised in connection with our service can't be circumvented. Hence, we can't guarantee that unauthorised 3rd-parties won't be capable of circumventing those measures or other safeguards in use or utilise the personal details and/or access for inappropriate purposes.
    Most interactions on the service, which include any submissions via available forms, are delivered through the basic HTTP Protocol & finished forms might be sent utilising daily email. Details delivered by HTTP & email aren't encrypted and, while these are simple interaction mechanisms, utilisation of these unsafe interaction approaches presents security and privacy risks. Any information transmission made by you to us or via the service is at your own risk. Your personal detail's security and safety also depend upon you.
